The online store oceanik.shop, managed by Oceanik d.o.o., (hereinafter the provider) is an information system intended for the presentation and sale of products to the user. The user is the person who uses our system, ie the customer in the online store. Upon registration in the online store, the visitor obtains a username that is the same as his e-mail address, which he determines in his profile and password. The username and password of the user are unambiguously determined and linked to the completed data.

The General Terms and Conditions and the use of the online store oceanik.shop are compiled in accordance with the Consumer Protection Act (ZVPot-UPB2), based on the recommendations of the Chamber of Commerce of Slovenia (GZS) and international codes for e-commerce.

The General Terms and Conditions deal with the operation of the online store oceanik.shop user rights and the business relationship between the provider, users and buyers of goods (hereinafter: buyers).

Company liability for factual errors

You can make a complaint due to a material error for each purchased product.

Pursuant to Article 37 of the Consumer Protection Act, an error is material in the case of:

  • if the product does not have the properties necessary for its normal use or for marketing
  • if the product does not have the properties necessary for the specific use for which the buyer is buying it, but which was known to the seller or should have been known to him
  • if the product does not have the characteristics and features that have been explicitly or tacitly agreed or prescribed
  • if the seller has delivered a thing that does not match the pattern or model, unless the pattern or model was shown only for the purpose of notification

The suitability of the products is assessed in relation to conventional products of the same type and taking into account the statements on the characteristics of the goods by the supplier or Oceanik d.o.o.

Due to a material defect, you can report the defect to the seller within two months of the discovery of the material defect or within two years of taking over the goods. At your option, you can request: (1) rectification of the defect, (2) refund of the amount paid in proportion to the defect, (3) replacement of the goods, (4) refund of the amount paid.

When exercising the rights under this title, you must describe the error in more detail in the error notification and allow us to inspect the product. If the error is not disputed, we must grant your claim as soon as possible and within 8 days at the latest. However, if there is a dispute about the error, we must provide you with a written response within 8 days.

The right to assert a material defect in an article is regulated in more detail by the provisions of the Consumer Protection Act (ZVPot).

Description of technical procedures for concluding the contract

  1. PURCHASE AS A “REGISTERED USER” OR AS A “GUEST”

You can place an order as a registered user or as a guest.

1.1 PURCHASE AS A “GUEST”

If you decide to make a purchase as a guest, you must re-enter your personal information each time you make a purchase. Fields marked with an asterisk are required. Confirm the registration by clicking on the REGISTRATION button.

In case you leave a mandatory field blank, it will direct you back to the registration form, which will indicate which data you forgot to enter or where you went wrong.

1.2 Purchase as a registered user

If you want to register in the oceanik.shop online store, you need a valid e-mail address to register, where you will be sent an e-mail with registration information. You must enter your personal information when registering. By registering, you save time on later purchases, as you do not have to enter personal data every time, and you also have a history of past orders in your MY ACCOUNT profile. Fields marked with an asterisk are required. Confirm the registration by clicking on the “REGISTRATION” button. In case you leave a mandatory field blank, it will direct you back to the registration form, which will indicate which information you forgot to enter or. where you went wrong. To view the product offer, browse our offer, promotions or read the descriptions of individual products. There are various filters available on the website that allow you to get to the desired product as quickly as possible. When you find the product you want to order, click the ADD TO CART icon. In the CART you can keep track of how many items you have in it. If you stop with the mouse on the CART button, you will see a list of items you have in the cart, the total amount and the CASHIER button. When you want to complete the purchase in the CART, click the CASHIER button and follow the purchase steps.

Contracts are concluded in the English language. The contract or order is sent to the buyer to the e-mail address entered by the buyer. We store them in electronic form at the company’s headquarters. Customers can request a copy via our email address: info@oceanik.shop

Availability of information

 Pursuant to Article 43 b of the ZvPot, the bidder undertakes to provide the buyer with the following information before being bound by the contract or offer:

  • company identity (company name and registered office, registration number),
  • contact information that enables the user to communicate quickly and efficiently and eliminate any problems (e-mail, telephone),
  • essential characteristics of goods or services from the online store offer (including after-sales services and guarantees),
  • availability of products (any product or service offered by the online store should be available within a reasonable time),
  • conditions of delivery of the product or execution of the service (method, place and deadline of delivery),
  • all prices must be clearly and unambiguously set, it must be clear whether they already include taxes and transport costs,
  • method of payment and delivery,
  • time validity of the offer,
  • the period within which it is still possible to withdraw from the contract and the conditions for withdrawal; in addition, if and how much it costs the customer to return the product,
  • an explanation of the complaint procedure, including all details of the contact person or customer service.
  • on the absence of the right to withdraw from the contract if the consumer does not have the right to withdraw in accordance with the fifth paragraph of Article 43.č of the Consumer Protection Act, or if necessary on the circumstances in which the consumer loses the right to withdraw from the contract

Package delivery service and delivery times

DPD, as a provider of delivery services, delivers packages on working days from Monday to Friday – in Slovenia usually within 24 or 48 hours. However, this standard package delivery time is not guaranteed. DPD packages are transported by road, so traffic jams can cause delays. In Europe, standard delivery times to neighboring countries range from 48 to 72 hours, and to more remote countries from 72 to 120 hours.

Products under the Hollis, Oceanik, Zeagle, Atomic aquatics and Stahlsac brands are only shipped to Slovenia, Croatia and Serbia.

Prices and validity of the offer

All prices in the online store are stated in € (euros) and include VAT, the provider (Oceanik d.o.o.) is liable for VAT. All prices in the online store are the prices of products with VAT and do NOT include delivery costs.

The prices listed in the online store are irrevocable and are valid in the case of payment with the payment methods listed below, under the conditions listed below.

Despite tremendous efforts to provide the most up-to-date and accurate information, price information may be inaccurate. In this case, or in the event that the price of the item changes during the processing of the order, the provider will allow the buyer to withdraw from the purchase, and at the same time the provider will offer the buyer a solution that will go to mutual satisfaction.

The provider reserves the right to change prices without prior notice.

SPECIAL OFFERS-DISCOUNTS

The validity periods of the special offer are valid until canceled. When buying, the prices are valid at the time of order confirmation. The offer is valid until canceled.

Users of the online store can buy products at special prices and discounted prices. Various campaigns, promotions and other marketing techniques will be marked accordingly. Also, for each product for which the promotion or discount price applies, the conditions of participation will be clearly defined.

DISCOUNT PROMOTION CODES AND GIFT VOUCHER

As a way of special promotion, users can also buy certain products with the help of discount promotional codes or gift vouchers, which they receive in various ways (via SMS, on flyers, on social networks ..). The promotional code brings various benefits when purchasing and is time-limited. Codes and rules of use will be clearly defined. Code entry is enabled for each product in the first step of the online order – Cart. 

Methods of payment

When shopping online, the provider allows the following methods of payment:

COLLECTION PAYMENT: For cash on delivery, you will pay the delivery service in cash.

PAYMENT BY DEBIT OZ. CREDIT CARD: We enable payments with Visa and Mastercard. When you make a payment by debit or credit card, your order will be processed immediately. Once your card information has been verified and approved by the system, your package will be mailed.

PAYMENT BY PROFORMA INVOICE / OFFER: After receiving the offer to your e-mail address, you pay the amount via a transaction account 

Issuance of invoice

The seller must issue an invoice for the supply of goods or services to the buyer and hand it over to the buyer. The customer must take over the invoice and keep it directly upon departure from the business premises. When making a purchase in our online store, the customer receives the invoice together with the product by mail.

Right of withdrawal from the purchase, return of goods

In the case of distance contracts, the consumer (according to Articles 43c and 43d ZVPot) has the right to notify the company within 14 (fourteen) days to the e-mail address info@oceanik.shop that he withdraws from the contract without the reason for its decision must be stated. The deadline starts one day after the date of receipt of the items.

Returned goods must be in the original packaging, unused and undamaged.

The consumer must return the goods to the company no later than 14 (fourteen) days after the notification of withdrawal from the order. The consumer returns the goods to the address: Oceanik d.o.o, Vanganelska cesta 18, 6000 Koper.

Upon receipt of the goods, the company returns all payments received to the consumer in accordance with the law. The only cost borne by the consumer in connection with the withdrawal is the direct cost of returning the goods. We do not accept Cash on delivery shipments.

The customer must notify the e-mail address info@oceanik.shop within 14 days of the intention to return the product, and we will send instructions for return. The customer then has another 14 days to return the product to our address. Otherwise, unfortunately, we cannot return the money.

Repayment of received payments will be made as soon as possible, but no later than within 14 days of receipt of the notice of withdrawal from the contract. The company shall return the payments received to the consumer by the same means of payment as used by the consumer, unless the consumer has explicitly requested the use of another means of payment and the consumer does not incur any costs as a result.

The withdrawal form is available to the consumer here (withdrawal form). An unequivocal statement by the consumer, from which it is clear that he is withdrawing from the contract, is also sufficient.

Upon withdrawal from the contract where the credit or discount code was used, these funds are considered a discount and are not returned to the user. Only the paid amount is returned to the user’s bank account. The credit is considered as a means of payment upon withdrawal from the contract and is returned to the user as credit.

Complaints and disputes

The provider complies with applicable consumer protection legislation. Complaints can be sent by users by e-mail info@oceanik.shop or by regular mail to the address: Oceanik d.o.o., Vanganelska cesta 18, 6000 Koper, Slovenia.

The bidder must, within 5 (five) working days, confirm that it has received the complaint, inform the user how long it will take to process it and keep him informed of the progress of the procedure. The provider strives to the best of its ability to resolve any disputes amicably.
In accordance with legal norms, we do not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act. 

Oceanik d.o.o., which as a provider of goods and services enables online trade in the territory of Slovenia, publishes on its website an electronic link to the platform for online resolution of consumer disputes (SRPS). The platform is available to consumers at the link HERE.

In the event of a litigation, the competent court is in Koper.

The General Terms and Conditions and all other information can be changed by Oceanik d.o.o.  without prior notice.
